Shades of FDR: He is well aware that it not constitutional as all 9 members of the SCOTUS are aware. He was slapped down 9-zip in his last fight with them. The Federal Govt has well defined and understood enumerated powers. What the SCOTUS is really debating is what freedoms that we have left should be done away with. If this law is upheld the radical czars will dream up tens of thousands of rules and regulations that will control every aspect of our lives. Just as they now tell us what toilet, shower head and light bulbs that we can purchase the same will be applied to food, drinks, smoking and drinking. This is just for starters.
